Degree
Arson is a crime that is defined by five different degrees. All
of which are punishable by a fine and imprisonment. A short
description of each degree follows:
Arson in the first degree - is a FELONY and
punishable by a fine of not more than Twenty-five thousand dollars
($25,000) or be confined to the penitentiary for not more than
thirty-five (35) years or both.
Arson in the second degree - is a FELONY and
punishable by a fine of not more than Twenty thousand dollars
($20,000) or be confined to the penitentiary for not more than
twenty-five (25) years or both.
Arson in the third degree - is a FELONY and
punishable by a fine of not more than Ten thousand dollars
($10,000) or be confined to the penitentiary for not more than
fifteen (15) years or both.
Arson in the fourth degree - is a FELONY and punishable
by a fine of not more than five thousand dollars ($5,000) or be
confined to the penitentiary for not more than ten (10) years or
both.
Arson in the fifth degree - is a FELONY and
punishable by a fine of not more than Ten thousand dollars
($10,000) or be confined to the penitentiary for not more than ten
(10) years or both.
